Terms of Use
Motion Photo Maker · Android package com.livephoto.motionphoto.maker
Last updated: 22 September 2026 · Effective: 22 September 2026
The short version.
Everything you make with Motion Photo Maker is yours. We never receive it, claim no rights over it, and you are free to use it however you like, including commercially.
The App is free to use with ads and a daily export allowance. An optional subscription removes both. Subscriptions are billed by Google Play, renew automatically until you cancel, and are cancelled in Google Play — not here.
These Terms of Use (“Terms”) are an agreement between you and us about your use of the Motion Photo Maker mobile application (the “App”). Please read them before using the App. By downloading, opening or using the App, you accept these Terms. If you do not accept them, do not use the App.
1. Who we are
The App is published by BitDance AI Studio - Fun, Creative & Smart Tools (“BitDance AI Studio”, “we”, “us”, “our”) — the developer name shown on our Google Play listing. You can reach us at bitdancetech@gmail.com.
How we handle data is described separately in our Privacy Policy, which forms part of these Terms.
2. Who may use the App
You must be at least 13 years old to use the App, or at least 16 if you are in the European Economic Area or the United Kingdom — or older, where the law of your country sets a higher minimum age for this kind of service. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or guardian, who accepts these Terms on your behalf.
You must also be legally able to enter into this agreement, and not barred from using the App under any applicable law.
3. Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own purposes. This licence exists for as long as you comply with these Terms.
You may not:
- copy, sell, rent, sublicense or otherwise redistribute the App itself;
- reverse engineer, decompile or disassemble the App, or attempt to derive its source code, except to the extent that applicable law expressly permits this despite this restriction;
- remove or alter any copyright, trademark or other proprietary notice;
- circumvent, disable or interfere with the App’s billing, export limits, advertising or security mechanisms, or use modified or unofficial builds of the App;
- use automated means to access or operate the App at a scale or in a manner it is not designed for.
4. Your content
You keep every right you have in what you create. Photos, videos, Live Photos, text and any other content you shoot, import or produce with the App belong to you. We claim no ownership and take no licence over them.
We are not able to take a licence even if we wanted to: your content is processed entirely on your device and is never transmitted to us. See the Privacy Policy.
Because your content stays on your device, two things follow, and both are your responsibility:
- Back it up. We hold no copy of anything. If a file is lost, deleted, overwritten or corrupted — including if you uninstall the App, clear its storage, or a device fault occurs — we cannot recover it for you.
- Make sure you have the right to use it. You are responsible for the content you capture or import, and for having the necessary rights and permissions — including the consent of any identifiable person appearing in it, where consent is required where you are.
What you export is yours to use freely, including for commercial purposes, subject only to Section 7.
5. Free use, ads and rewarded unlocks
The App is free to download and use. The free tier is supported by advertising and includes a daily allowance, which works as follows:
| Free tier | How it works |
|---|---|
| Daily exports | A number of exports each day at no cost. Once that allowance is used, further exports for that day can be unlocked one at a time by watching a rewarded ad, up to a daily maximum. Beyond that maximum, exporting requires a subscription until the allowance resets. |
| Premium filters, effects and materials | Items marked as premium can be previewed for free. Watching a rewarded ad unlocks a group of them temporarily — currently 24 hours — after which they lock again unless unlocked once more or covered by a subscription. Some introductory groups unlock permanently. |
| Bonus allowances | The App may grant extra exports through features such as daily check-in. These are a courtesy, hold no cash value, cannot be exchanged, transferred or refunded, and may expire or be changed at any time. |
| Advertising | Banner, native, interstitial, app-open and rewarded ads are shown. Ads come from third-party networks and we do not control which specific ad you see. An active subscription removes all advertising. |
Exact allowances, unlock durations and which items are premium are set in the App and may change between versions as we adjust the product. The figures above describe the current design, not a guarantee.
6. Subscriptions and payment
The App offers optional auto-renewing subscriptions that remove advertising and export limits and unlock premium content. Weekly, monthly and yearly plans may be offered; the plans, prices and any introductory or free-trial offers available to you are shown in the App before you confirm, in your local currency, and are the authoritative terms of your purchase.
How billing works
- Google Play handles payment. All purchases are processed by Google Play under your Google account. We never see or handle your payment details.
- Subscriptions renew automatically. Your subscription renews at the end of each billing period and your payment method is charged, unless you cancel at least 24 hours before the period ends.
- Cancelling. Cancel at any time in Google Play (Play Store → Subscriptions) or at play.google.com. Cancelling stops the next renewal; you keep access until the end of the period you have already paid for. Uninstalling the App does not cancel a subscription.
- Free trials. Where a free trial is offered, it converts into a paid subscription at the end of the trial unless you cancel before it ends. Any unused part of a trial is forfeited when you subscribe.
- Price changes. If we change the price of a plan, Google Play will notify you and ask for your consent before the new price applies, as its rules require. You may cancel instead.
Refunds
Purchases are made through Google Play, and refunds are governed by Google Play’s refund policy. Requests should go to Google Play in the first instance. We cannot issue refunds for purchases we did not process, but if something goes wrong on our side — for example you are charged and the subscription does not activate — contact us and we will help you resolve it.
This does not affect any statutory right to a refund or to withdraw from a contract that you may have as a consumer; see Section 15.
7. Filters, templates, music and fonts
The App includes creative materials — filters and lookup tables, effects, stickers, frames, templates, background music and fonts — that are either ours or licensed to us.
- You may use these materials within the App and share, publish or sell the finished photos, videos and Live Photos you create with them, including commercially.
- You may not extract, copy or redistribute the materials themselves, as materials — for example, pulling the music tracks, lookup tables, sticker artwork or font files out of the App to use or distribute separately.
The built-in music library consists of tracks released under CC0 / public domain dedications. Fonts you select in the text editor are downloaded from Google Fonts and remain subject to their own open-source licences.
8. AI features
Some tools — including image enhancement, object removal, background removal, subject effects and beauty retouch — use machine-learning models that run on your device. Please understand:
- Results vary and are not guaranteed. Output quality depends on your image, your device and its hardware. These tools may produce imperfect, unexpected or unusable results, or may fail outright. They are provided for creative use, not for any purpose requiring accuracy, authenticity or forensic reliability.
- Some models are downloaded on first use and need a network connection and free storage. Where a model is unavailable, the App falls back to a simpler method or the feature is unavailable.
- You are responsible for what you produce. Edited images can mislead. You must not use these tools to create content that deceives, defames, impersonates, or otherwise harms anyone — see Section 9.
- Hardware requirements. Some features need capabilities your device may not have. We do not warrant that every feature works on every device.
9. Acceptable use
You agree not to use the App to create, edit or distribute content that:
- is unlawful where you are, or that infringes anyone’s copyright, trademark, privacy, publicity or other rights;
- sexualises minors, or depicts any person in a sexual manner without their consent;
- harasses, bullies, threatens, defames or incites violence or hatred against any person or group;
- impersonates a real person, or fabricates events or statements in a way intended to deceive — including deceptive synthetic or “deepfake” imagery;
- captures or edits images of people in circumstances where they have a reasonable expectation of privacy, or where local law requires consent you do not have.
You are solely responsible for your use of the App and for the content you produce with it. Because your content never reaches us, we do not and cannot review, moderate or remove it — which makes your compliance with this section entirely your own responsibility.
10. Our intellectual property
The App, its name, logo, user interface, source code, shaders and included materials are owned by us or our licensors and are protected by copyright and other laws. These Terms grant you a licence to use the App, and transfer no ownership. All rights not expressly granted are reserved.
Third-party names and marks referenced in the App or in these Terms belong to their respective owners and are used for identification only.
11. Availability and changes to the App
We may add, change, suspend or discontinue features at any time, and may release updates that change how the App looks or works. Some updates may be required for the App to keep functioning. We may also stop distributing or supporting the App altogether. Where we withdraw a feature you have paid for and cannot offer a reasonable equivalent, contact us and we will deal with it fairly, in line with applicable consumer law.
The App depends on your device, your network and third-party services such as Google Play. We do not guarantee uninterrupted or error-free operation.
12. Termination
You may stop using the App at any time by uninstalling it. Remember to cancel any subscription separately in Google Play — uninstalling does not cancel it.
We may suspend or terminate your licence to use the App if you materially breach these Terms — for example by circumventing billing or export limits, or by using the App for the prohibited purposes in Section 9. Where it is reasonable and lawful to do so, we will give you notice and an opportunity to put things right first.
Sections that by their nature should survive termination — including 4, 7, 10, 13, 14, 15 and 16 — continue to apply afterwards.
13. Disclaimers
The App is provided “as is” and “as available”, without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from course of dealing or usage of trade.
Without limiting the foregoing, we make no representation or warranty that the App will meet your requirements, achieve any particular result, be compatible with any device or other software, operate without interruption or error, or that defects will be corrected; nor as to the accuracy, reliability or quality of anything produced using the App, including output from the AI features described in Section 8.
Some jurisdictions do not allow the exclusion of certain warranties or of implied statutory consumer rights. Where that is the case, the exclusions above apply only to the greatest extent permitted by the law that applies to you, and your mandatory statutory rights are unaffected.
14. Limitation of liability
To the maximum extent permitted by applicable law, we and our suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, content or goodwill, or for business interruption or loss of privacy, arising out of or in connection with the App or these Terms — even if we have been advised of the possibility of such damages and even if a limited remedy fails of its essential purpose.
To the maximum extent permitted by applicable law, our total liability for all claims relating to the App or these Terms is limited to the greater of (a) the amount you actually paid us, or paid through the App, in the twelve months before the event giving rise to the claim, or (b) USD 100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any mandatory statutory liability owed to consumers. Some jurisdictions do not allow the limitation of incidental or consequential damages, so parts of this section may not apply to you.
You agree to indemnify and hold us harmless from claims, damages and reasonable costs arising from content you create with the App or from your breach of these Terms. This does not apply where you are a consumer and the law of your country does not permit it.
15. Governing law, disputes and consumer rights
These Terms are governed by the laws of the People’s Republic of China, excluding its conflict-of-law rules. Your use of the App may also be subject to other local, national or international laws.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country where the law gives you that right.
Consumers in the European Union, the EEA and the United Kingdom. You normally have a 14-day right to withdraw from a contract for digital content or services. Where you ask for performance to begin immediately — which is what happens when a subscription activates at once — and acknowledge that you will lose that right, the right to withdraw ends once performance has begun. Statutory rights in respect of digital content that is faulty or not as described are unaffected. If a dispute cannot be settled with us directly, you may approach an alternative dispute resolution body in your country; the European Commission publishes the list of certified ADR bodies. (The EU Online Dispute Resolution platform was discontinued on 20 July 2025.)
Before formal proceedings, please contact us at bitdancetech@gmail.com. Most problems are quicker to solve by e-mail, and we will make a genuine effort to resolve your issue.
United States export and sanctions compliance. You represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that you are not on any United States government list of prohibited or restricted parties.
16. General terms
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App, and replace any earlier version of these terms.
- Severability. If any provision is found unenforceable, it will be applied as far as it lawfully can be, and the remaining provisions stay in force.
- No waiver. If we do not enforce a right immediately, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to an affiliate or in connection with a merger, acquisition or sale of assets, provided your rights are not reduced.
- Google Play. Your use of the App is also subject to the Google Play Terms of Service. Google is not a party to these Terms and has no obligation to provide support for the App.
- Translation. If these Terms are made available in another language, the English text prevails in the event of a discrepancy, except where the law that applies to you provides otherwise.
17. Changes and contact
We may modify these Terms as the App changes or as the law requires. The updated version is posted on this page with a new “Last updated” date. For material changes we will make reasonable efforts to give notice — in the App or on this page — at least 30 days before they take effect. Continuing to use the App after that means you accept the revised Terms; if you do not accept them, stop using the App and cancel any subscription.
